Sharing Archival Collections in the 21st Century: Legal Issues

Archives have priceless riches in their collections. As more and more tools spring forth making it easier to share collections online, legal issues become more salient than ever before.  When may an archive share those collections online without violating copyright, privacy or other laws?  What rights are transferred when archives post collections to social media?  When may archives make copies available to users?  What considerations are added to the mix with content that is born digital?

This workshop will offer an exploration of copyright, privacy and other legal issues most relevant to the 21st century archivists.  Participants are invited to bring samples from special collections that present unresolved issues.

Instructor: Mary Minow

Mary Minow is Counsel to the Califa Group and a Library Law consultant on issues of copyright, privacy, intellectual freedom and related access to information legal issues. She is the co-author with Tomas Lipinski of The Library's Legal Answer Book (ALA: 2003). She manages the Stanford Copyright & Fair Use site and tweets at both @fairlyused and @librarylaw. She also teaches Digital Copyright as the Follett Chair, Dominican University. She has a J.D.  from Stanford and an M.L.S. From the University of Michigan.
